LOCAHIRI — TERMS & CONDITIONS (TERMS OF USE)

In these Terms, unless the context requires otherwise:

• •"Candidate(s)" means any natural person who visits the website, submits an application, or otherwise uses the Site to apply for job opportunities.
• •"Company" or "Partner Company" means any employer, recruiter, or third party that provides job specifications to Locahiri or receives candidate dossiers from Locahiri (including Chinese companies).
• •"Job Offer" or "Listing" means a vacancy published by Locahiri on the Site, whether created directly by Locahiri or provided to Locahiri by a Chinese Company.
• •"Services" means any features made available by Locahiri via the Site, including job listings, candidate eligibility checks, candidate forwarding to Companies, and related services.

2.1. Locahiri operates an online platform that publishes job opportunities and connects Candidates to Chinese hiring Companies. Locahiri creates and publishes Job Offers based on information provided to us by the Chinese Companies and may edit formatting or presentation for clarity.

2.2. Locahiri provides a preliminary eligibility check (the “Eligibility Check”) of Candidate information prior to forwarding candidate dossiers to certain partner Companies (including, where applicable, Companies located in China). Locahiri’s Eligibility Check is an administrative screening only (verification of documents, minimum qualifications, basic eligibility criteria) and does not guarantee candidate selection, job offers, employment, visas, relocation, or any other final outcome. Final hiring decisions, contractual terms of employment, and any immigration or visa processes are exclusively the responsibility of the hiring Company. See Article 6 for additional disclaimers.

4.1. Source and accuracy. Job Offers available on the Site are published by Locahiri based on information provided by Companies or created by Locahiri staff from data provided to us. While we strive to ensure accuracy and clarity, Locahiri does not guarantee the completeness, timeliness, or accuracy of Job Offer details; Companies remain responsible for the substantive content of job descriptions they provide.

4.2. Editing and presentation. Locahiri may edit, translate, or transform job details for presentation purposes (formatting, translation, summarization). Edits are intended to improve clarity and are not endorsements.

4.3. Fees for Companies. If you are a Company posting jobs through Locahiri, additional terms (pricing, invoicing, content rules) are governed by a separate agreement between Locahiri and the Company.

5.1. Eligibility Check. When you submit your application to a Job Offer that requires forwarding to a Company (including international partners), Locahiri will conduct an initial Eligibility Check. This check may include validating identity documents, verifying that you meet the minimum qualification or experience stated by the Company, and confirming that your application files are complete.

5.2. Limitation of the Eligibility Check. The Eligibility Check is an administrative measure and is not a background check, criminal record check, medical check, visa check, or other regulatory clearance unless Locahiri explicitly states otherwise and obtains your separate consent.

5.3. Consent to forward. By submitting an application, you expressly consent to Locahiri forwarding your application, CV and supporting documents to the relevant Company and partner organizations (including Companies located in China or other jurisdictions) for recruitment consideration.

5.4. Cross-border transfers. Where dossiers are forwarded to Companies located outside your country of residence, you consent to cross-border transfer of your personal data. Such transfers will be made pursuant to applicable data protection laws and our Privacy Policy.

5.5. No guarantee of employment. Locahiri does not guarantee that a Company will contact you, interview you, or offer employment. Locahiri does not guarantee terms of employment, salary, benefits, or visa/immigration assistance. The final employment contract is between you and the hiring Company.

6.1. Communication channels. Companies may contact Candidates directly following forwarding. Locahiri may facilitate introductions but is not a party to any negotiation or employment contract between Candidate and Company.

6.2. Candidate responsibilities. Candidates must ensure all data and documents submitted are truthful and accurate. Candidates remain responsible for responding to Company requests and for attending interviews or assessments.

6.3. Fraud and misrepresentation. You must not impersonate others or provide false documents. Locahiri reserves the right to remove content and report illegal activity to authorities.

7.1. Free candidate services. Generally, use of the Site by Candidates to apply for Job Offers is free unless otherwise indicated.

7.2. Company fees. Charges for Companies posting Job Offers or using paid services are governed by separate commercial terms and invoices.

7.3. Refunds. Any paid service refund policy will be specified in the applicable invoice or order form between Locahiri and the paying party.

8.1. Your representations. By submitting any content (resume, cover letter, photographs, certificates, comments), you represent and warrant that:

• •you own or are authorized to submit that content;
• •the content is accurate, truthful and not misleading;
• •the content does not violate third-party rights (intellectual property, privacy, publicity) or applicable law.

8.2. License to Locahiri. By submitting content to the Site you grant Locahiri a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, adapt, publish and share that content to the extent necessary to provide the Services (including forwarding to Companies), for the duration necessary to perform the Services and as described in our Privacy Policy.

8.3. User-generated content. Locahiri is not responsible for user-generated content and does not guarantee its accuracy or legality.

9.1. Site content. All Site content created by Locahiri (text, designs, logos, graphics, images, video, code, layout, databases) is owned by or licensed to Locahiri and protected by intellectual property laws. You may view and print copies of Site pages only for personal, non-commercial use.

9.2. Trademark notice. "Locahiri" and other Locahiri logos and marks are trademarks of Locahiri. You may not use them without our written consent.

10.1. Privacy Policy. Our Privacy Policy explains how we collect, use, share and protect personal data, including the processing performed when we forward candidate dossiers to partner Companies. By using the Site you consent to processing as described in the Privacy Policy.

10.2. Third-party recipients. Personal data forwarded to Companies will be processed by those Companies under their own privacy practices; Locahiri is not responsible for third-party privacy compliance once data is transmitted unless otherwise agreed.

10.3. Data subject rights. If you wish to exercise data rights (access, rectification, erasure, objection, portability), please consult our Privacy Policy or contact us at contact@locahiri.com.

11.1. No employment agent. Unless expressly stated in a written agreement, Locahiri is a platform and intermediary facilitating connections between candidates and Companies. Locahiri is not the employer, recruiter, recruitment agency, or guarantor of any Company.

11.2. No guarantee of results. Locahiri makes no warranty that any job application will lead to an interview, offer, or employment.

11.3. Service provided “as is.” Except where law requires otherwise, Locahiri provides the Site and Services on an “as is” and “as available” basis and expressly disclaims all warranties (express or implied), including fitness for a particular purpose, accuracy, or non-infringement.

12.1. To the maximum extent permitted by law, Locahiri’s total liability to you for damages arising from or relating to use of the Site or Services shall not exceed the total fees paid to Locahiri by you in the prior 3 months. In no event will Locahiri be liable for any indirect, incidental, special, consequential, punitive or exemplary damages (including lost profits, loss of good will, loss of data) even if advised of the possibility of such damages.

12.2. Exclusions. Nothing in these Terms excludes or limits liability for death or personal injury caused by Locahiri’s proven negligence, or for any other liability that cannot be excluded or limited by law.

You agree to indemnify, defend and hold harmless Locahiri, its officers, directors, employees and agents from and against any and all third-party claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with:

• •your breach of these Terms;
• •your content submitted to the Site;
• •your violation of any third-party right (including intellectual property or privacy rights);
• •your misuse of the Site.

14.1. Termination by Locahiri. Locahiri may, at its sole discretion and without prior notice, limit, suspend or terminate your access to the Site and Services (in whole or in part) if you violate these Terms, engage in fraudulent or abusive behavior, or when otherwise necessary to protect the Site, other users or Locahiri.

14.2. Consequences. Upon suspension or termination, your right to use the Site ceases. Locahiri may delete or retain your content in accordance with our retention policies and applicable law.

14.3. Survival. Provisions that by their nature should survive termination (e.g., Sections 8, 9, 11, 12, 13, 15) will survive.

15.1. Governing law. These Terms are governed by the laws of the People’s Democratic Republic of Algeria. You and Locahiri submit to the exclusive jurisdiction of the courts located in Constantine to resolve any disputes arising out of or relating to these Terms, except where mandatory local laws provide otherwise.

16.1. We may modify these Terms from time to time. We will post the updated Terms on the Site with a revised "Last updated" date. Continued use after posting constitutes acceptance of the revised Terms.

16.2. Material changes: where we make a material change we will attempt to notify registered users via email or prominent notice on the Site.

17.1. Entire agreement. These Terms and any additional agreements or policies expressly incorporated by reference constitute the entire agreement between you and Locahiri regarding the Site and Services.

17.2. Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

17.3. Assignment. Locahiri may assign or transfer these Terms and its rights and obligations under them without your consent (including in connection with mergers, acquisitions, or sale of assets). You may not assign these Terms without Locahiri’s express prior written consent.
